At Being K Ltd, we are committed to delivering high-quality services and maintaining transparent, fair commercial relationships with every client. This Refund Policy sets out the terms that apply when you purchase services or downloadable resources from us. Please read it carefully before making a purchase.

This policy applies to all three of Being K Ltd’s commercial models: Standalone Services, Tailored Services, and Custom Solutions. Where this policy and your signed Client Contract Agreement conflict, the signed contract prevails for Tailored Services and Custom Solutions engagements.

This policy forms part of Being K Ltd’s Terms and Conditions, available at being-k.com/terms-and-conditions/.

 

1. Standalone Services

Standalone Services are fixed-price services purchased directly through the Being K Ltd shop at being-k.com/services/.

 

1.1 Cancellation Before Work Begins

If you wish to cancel a Standalone Services purchase before Being K Ltd has commenced work (that is, before we have begun reviewing your brief, conducting research, or producing any deliverables), you may request a full refund within 48 hours of purchase.

To be eligible for a full refund under this clause:

  • Your cancellation request must be submitted within 48 hours of the purchase confirmation email; and
  • Being K Ltd must not have commenced any work on your order at the time of the request.

Full refunds under this clause will be issued less any payment processing fees charged by our payment provider, which are outside Being K Ltd’s control.

 

1.2 Cancellation After Work Has Begun

Once Being K Ltd has commenced work on your Standalone Services purchase (including initial research, strategy development, content production, or any preparatory work), no full refund will be issued.

If you cancel after work has begun but before final delivery, a partial refund may be available. The amount will be calculated based on the proportion of work not yet completed at the time of your cancellation request. Being K Ltd will assess the work completed and communicate the refund amount to you within 5 business days of your request.

 

1.3 After Delivery and Acceptance

No refund will be issued for Standalone Services that have been fully delivered and accepted. Work is considered accepted when:

  • You confirm acceptance in writing; or
  • 7 calendar days have passed since delivery without written revision requests; or
  • You publish, use, or deploy the delivered work in any medium.

If you are dissatisfied with delivered work, please contact us at contact@being-k.com before raising a formal refund request. We are committed to resolving concerns within the scope of your purchase.

 

2. Tailored Services

Tailored Services are Being K Ltd’s Marketing Packages and Web Design Packages, sold through a consultative process. Cancellation terms for Tailored Services are governed by the Client Contract Agreement signed at the time of onboarding. The following default terms apply in the absence of a signed contract.

 

2.1 Cancellation Before the Service Start Date

If you cancel a Tailored Services engagement in writing at least 14 calendar days before the agreed service start date, a cancellation fee of 20% of the total contract value will apply to cover administrative and preparation costs incurred by Being K Ltd.

 

2.2 Cancellation Within 14 Days of the Service Start Date

If you cancel within 14 calendar days of the agreed service start date, a cancellation fee equivalent to the full first month of service will apply.

 

2.3 Once a Tailored Services Engagement Is Underway

Once a Tailored Services engagement is underway, fees paid for the current billing period are non-refundable. Being K Ltd will continue to deliver services for the remainder of the paid period unless both parties agree otherwise in writing.

 

2.4 Proposal Validity

Any proposal provided by Being K Ltd in connection with a Tailored Services engagement is valid for 30 days from the date it was issued. After this period, Being K Ltd reserves the right to revise or withdraw the proposal. Once a proposal is accepted and a contract is signed, these cancellation terms apply.

 

3. Custom Solutions

Custom Solutions are fully bespoke engagements scoped and priced on an individual basis. All Custom Solutions are governed by a dedicated signed Client Contract Agreement and Statement of Work. The cancellation terms in that contract always take precedence over this policy.

In the absence of a signed contract, the default cancellation terms set out in Section 2 above apply to Custom Solutions engagements.

Being K Ltd will not commence work on a Custom Solution without a signed contract in place. If a Custom Solution engagement is cancelled after signing but before work begins, the terms of the signed contract govern any fees due.

 

4. Downloadable Resources

All purchases of downloadable resources (including templates, guides, eBooks, and other digital content) are non-refundable once the file has been downloaded or accessed.

Please review product descriptions carefully before purchasing to confirm the resource meets your needs. If you encounter a technical issue with a download or believe the product is faulty, please contact us within 7 days of purchase at contact@being-k.com. Being K Ltd will assess the issue and, where appropriate, offer a corrected file or an exchange.

While refunds are not available for downloadable resources once accessed, we are committed to ensuring you receive a working, accurate product.

 

5. Dissatisfaction Resolution

If you are dissatisfied with any service or deliverable, Being K Ltd encourages you to contact us at contact@being-k.com before raising a formal refund request. We are committed to resolving concerns professionally and will work with you to find a suitable remedy within the scope of your purchase.

Raising a complaint or dissatisfaction does not automatically entitle you to a refund, but Being K Ltd will always engage in good faith to find a fair resolution.

 

6. How to Request a Refund or Cancellation

  • Your full name and contact information
  • The service, package, or downloadable resource in question
  • Your order reference number (included in your purchase confirmation email)
  • The reason for your refund or cancellation request

 

Being K Ltd will respond to your request within 5 business days and work with you to resolve the matter promptly.

 

7. Refund Processing

Approved refunds will be processed to the original payment method used at the time of purchase. Processing times may vary depending on your bank or payment provider and are outside Being K Ltd’s control. Being K Ltd will confirm the refund amount and initiate the transaction within 10 business days of approving your request.

Refunds will be issued in US Dollars (USD). If you paid in a different currency, the refunded amount in your local currency may differ from the original charge due to exchange rate fluctuations. Being K Ltd is not responsible for any currency conversion differences.

 

8. Your Statutory Rights

If you are based in Kenya, you may have rights under the Consumer Protection Act (No. 46 of 2012), including under sections 55 to 62 relating to your rights to redress for unsatisfactory services. Nothing in this Refund Policy limits, excludes, or modifies any rights you have under applicable Kenyan consumer protection legislation. Where any provision of this policy conflicts with your mandatory statutory rights, your statutory rights prevail.

If you are based outside Kenya, you may have additional or different statutory rights under the laws of your own country that cannot be excluded by contract. Being K Ltd respects those rights. Where any provision of this policy conflicts with your mandatory statutory rights under the laws of your country, your statutory rights prevail.

 

9. Changes to This Policy

Being K Ltd reserves the right to update this Refund Policy at any time. Changes will be posted on this page with an updated last updated date. The policy in effect at the time of your purchase governs your refund rights for that transaction.
